I. ENVIRONMENTAL REGISTRATION
Entities subject to environmental registration (Article 49 of the Law on Environmental Protection 2020):
Projects (including those that commenced operation before January 1, 2022) that generate waste but are not subject to an Environmental Permit (EP) requirement.
Contents of environmental registration:
- General information on the investment project or facility;
- Type of production, business, or service; technology, capacity, products; raw materials, fuels, and chemicals used (if any);
- Types and quantities of waste generated;
- Measures for collection, management, and treatment of waste in accordance with regulations;
- Commitment to environmental protection implementation.
Timing of environmental registration:
- For projects subject to Environmental Impact Assessment (EIA): registration must be completed prior to official operation;
- For projects not subject to EIA: registration must be completed prior to the issuance of a construction permit, or prior to discharging waste into the environment in cases where a construction permit is not required.
II. EXEMPTION FROM ENVIRONMENTAL REGISTRATION
Entities not required to conduct environmental registration (as prescribed in Decree No. 08/2022/ND-CP, as amended and supplemented by Decree No. 05/2025/ND-CP and Decree No. 48/2026/ND-CP):
- Projects classified as state secrets related to national defense and security;
- Projects exempted from environmental registration in accordance with laws or resolutions of the National Assembly;
Projects that, upon operation, do not generate waste or simultaneously satisfy all of the following criteria:
- Hazardous waste (HW) generated regularly: < 20 kg/month or < 240 kg/year;
- Industrial solid waste (non-hazardous) generated regularly: < 100 kg/month or < 1,200 kg/year;
- Domestic solid waste: < 300 kg/day;
- Wastewater: < 5 m³/day and exhaust gas: < 50 m³/hour.
- Projects listed in Appendix XVI, comprising 11 categories of activities not subject to environmental registration.
